At Aranzazu Abogados we have successfully acted to obtain recognition of the inheritance rights of the stable partner of a French citizen resident in Barcelona who died intestate in France. The couple were not registered as a de facto union and, applying the Catalan Civil Code, the deceased’s same-sex partner, who was legally resident in Spain, has been declared heir after submitting extensive evidence, which therefore requires the application of the European Succession Regulation.
The particularity of this case is the very special situation of the unregistered partner, and the application of the Catalan Civil Code in relation to the Succession Regulation, with the added specificity of the conflict of laws with France, which does not recognise inheritance rights for a partner who is not registered.
