Legal proceedings against Euro Disney Park in Paris.
The firm, through its partner Arantxa Cagigal, has acted in legal proceedings against Euro Disney, legally assisting a Spanish citizen who booked a package holiday to enjoy a few days with her family in a hotel located inside the Disney park in Paris. On the first day of her stay, in winter, as she left the hotel there was a sheet of ice at the exit; she slipped and fractured her tibia and fibula, requiring surgery. A claim was filed before the courts of the consumer’s domicile against Euro Disney for contractual damages and, alternatively, non-contractual damages, applying Spanish law. The claim was based on the Package Travel Directive and Spanish Law 21/1995 of 6 July regulating package travel. Once the defendant was served in Paris, without the need for translation under the applicable EU Regulation, it contacted the lead lawyer and a settlement agreement was reached and judicially approved.
