{"id":148797,"date":"2025-03-11T09:07:39","date_gmt":"2025-03-11T09:07:39","guid":{"rendered":"https:\/\/aranzazu-abogados.com\/?p=148797"},"modified":"2026-10-01T11:50:10","modified_gmt":"2026-10-01T11:50:10","slug":"disinheritance-and-unworthiness-to-succeed","status":"publish","type":"post","link":"https:\/\/aranzazu-abogados.com\/en\/disinheritance-and-unworthiness-to-succeed\/","title":{"rendered":"Disinheritance and Unworthiness to Succeed"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">It is important to bear in mind that Spanish and foreign legislation provide for the possibility of disinheriting forced heirs: descendants and ascendants, if one of the grounds for disinheritance laid down by law or case law applies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Spain, it is important to bear in mind the regional (foral) laws, since they differ significantly from common law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the one hand, the&nbsp;<strong>general grounds<\/strong>&nbsp;are those that determine incapacity to succeed by reason of unworthiness, established in&nbsp;<a href=\"https:\/\/go.vlex.com\/vid\/127560\/node\/756?fbt=webapp_preview&amp;addon_version=6.9\" target=\"_blank\" rel=\"noreferrer noopener\">Art. 756<\/a>&nbsp;<a href=\"https:\/\/go.vlex.com\/vid\/127560?fbt=webapp_preview&amp;addon_version=6.9\" target=\"_blank\" rel=\"noreferrer noopener\">CC<\/a>, concerning acts committed, as the case may be, against the deceased, their spouse, a person with whom they had an analogous affective relationship, or any of their descendants or ascendants:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Anyone convicted by final judgment of&nbsp;<strong>an attempt on life<\/strong>, or sentenced to a&nbsp;<strong>serious penalty for causing injuries or habitually exercising physical or psychological violence<\/strong>&nbsp;within the family sphere.<\/li>\n\n\n\n<li>Anyone convicted by final judgment of&nbsp;<strong>offences against<\/strong>&nbsp;&nbsp;<strong>liberty<\/strong>,&nbsp;<strong>moral integrity<\/strong><strong>,&nbsp;<\/strong>&nbsp;<strong>sexual freedom and integrity<\/strong>, and&nbsp;<strong>family rights and duties<\/strong>. Also anyone&nbsp;<strong>deprived of parental authority<\/strong>, or&nbsp;<strong>removed from guardianship or foster care<\/strong>&nbsp;for a reason attributable to them.<\/li>\n\n\n\n<li>Accusing the deceased of an offence punishable by a&nbsp;<strong>serious penalty<\/strong>, if they are&nbsp;<strong>convicted of false accusation<\/strong>.<\/li>\n\n\n\n<li>An adult who&nbsp;<strong>knows<\/strong>&nbsp;<strong>of the violent death of the testator and does not report it within one month<\/strong>&nbsp;to the justice authorities when they had not already acted ex officio, except where there is no obligation to accuse.<\/li>\n\n\n\n<li>Anyone who, by threat, fraud or violence,&nbsp;<strong>compels the testator to make a will or to change it<\/strong>.<\/li>\n\n\n\n<li>Anyone who by the same means&nbsp;<strong>prevents another from making a will<\/strong>, or&nbsp;<strong>from revoking the one they have made<\/strong>, or&nbsp;<strong>substitutes, conceals or alters a later one<\/strong>.<\/li>\n\n\n\n<li>In the case of succession of a person with a disability,&nbsp;<strong>failure to provide the due care<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">On the other hand, the&nbsp;<strong>specific grounds<\/strong>&nbsp;are those directed at forced heirs: children and descendants (<a href=\"https:\/\/go.vlex.com\/vid\/127560\/node\/853?fbt=webapp_preview&amp;addon_version=6.9\" target=\"_blank\" rel=\"noreferrer noopener\">Art. 853<\/a><a href=\"https:\/\/go.vlex.com\/vid\/127560?fbt=webapp_preview&amp;addon_version=6.9\" target=\"_blank\" rel=\"noreferrer noopener\">CC<\/a>), parents and ascendants (<a href=\"https:\/\/go.vlex.com\/vid\/127560\/node\/854?fbt=webapp_preview&amp;addon_version=6.9\" target=\"_blank\" rel=\"noreferrer noopener\">Art. 854<\/a><a href=\"https:\/\/go.vlex.com\/vid\/127560?fbt=webapp_preview&amp;addon_version=6.9\" target=\"_blank\" rel=\"noreferrer noopener\">CC<\/a>) and spouses (<a href=\"https:\/\/go.vlex.com\/vid\/127560\/node\/855?fbt=webapp_preview&amp;addon_version=6.9\" target=\"_blank\" rel=\"noreferrer noopener\">Art. 855<\/a><a href=\"https:\/\/go.vlex.com\/vid\/127560?fbt=webapp_preview&amp;addon_version=6.9\" target=\"_blank\" rel=\"noreferrer noopener\">CC<\/a>). Among these grounds, <strong>denial of maintenance<\/strong><strong>without legitimate reason<\/strong>&nbsp;applies to all forced heirs. Likewise, ascendants and spouses share the grounds for disinheritance arising from the&nbsp;<strong>loss of parental authority<\/strong>&nbsp;under Art. 170 CC and from&nbsp;<strong>an attempt on the life<\/strong>, whether of the other parent or of the testator\u2019s spouse. Finally, the child or descendant has the exclusive ground of&nbsp;<strong>physical ill-treatment or<\/strong>&nbsp;serious verbal abuse, which includes&nbsp;<strong>psychological abuse<\/strong>; as well as the spouse, for&nbsp;<strong>breach<\/strong><strong> <\/strong><strong>of conjugal duties<\/strong>&nbsp;that is serious or repeated.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Spanish and foreign law allow forced heirs to be disinherited on legally defined grounds; unworthiness to succeed has its own general grounds under Article 756 of the Civil
